Sometimes a conflicting trademark gets in your way. It might show up in a clearance search. Or maybe the USPTO refused your application because of it. If that registration looks like it’s no longer in use, or if you were using your brand first, we’ll help you file a Petition to Cancel and fight for your rights.

Note: We ONLY take on cancellation matters that we believe have a high chance of success through default or early settlement.

THE FINE PRINT

  • We start with strategy. We’ll review your situation and clarify our plans to challenge the conflicting mark as efficiently and cost-effectively as possible
  • We handle the filing. Our team will prepare and file your Petition to Cancel with the USPTO.
  • We send a demand letter (if needed). When helpful, we’ll contact the other party to propose a peaceful resolution and include a draft coexistence agreement.
  • We handle early-stage response. If the other side responds to the Petition to Cancel (they have 40 days to do so), we’ll represent you in the required discovery conference and early settlement talks. If appropriate, we’ll negotiate a coexistence agreement on your behalf.

This is a limited-scope package. If the case becomes more adversarial or requires full discovery and litigation before the Trademark Trial and Appeal Board, we’ll connect you with a trusted litigation attorney.

Plus $600 per class USPTO filing fee.
